1. Parties

These Terms constitute a legally binding agreement between you ("User" or "you") and AN KHUE SMART regarding your access to and use of the Services, including our websites, mobile applications, games, virtual items, and any content or features made available through them.

2. Scope of the Services

AN KHUE SMART continuously updates, changes and develops the Services at its own discretion. New features may be added, existing features may be modified or removed, and the Services may change in look, feel and functionality at any time without prior notice.

You are responsible for keeping the hardware and software you use to access the Services up to date and compatible. AN KHUE SMART is not obligated to support outdated devices, operating systems or application versions.

AN KHUE SMART reserves the right to suspend or cease operating any or all of the Services, in whole or in part, at any time and without explanation or liability to you.

3. Grant of License

Subject to your compliance with these Terms, AN KHUE SMART grants you a limited, non-exclusive, non-transferable, non-sublicensable and revocable license to access and use the Services solely for your own personal, non-commercial entertainment purposes.

• Use cheats, exploits, automation software, bots, hacks, mods or any unauthorized third-party software designed to modify or interfere with the Services;

• Post or transmit any content that is unlawful, obscene, offensive, hateful, or otherwise objectionable;

• Collect, harvest or scrape any data or personal information from the Services or other users without authorization;
• Reverse engineer, decompile, disassemble or otherwise attempt to derive the source code of the Services, except to the extent permitted by applicable law;
• Circumvent, disable or interfere with any security-related features of the Services.

5. Accounts

Certain features of the Services may require you to create an account. You must be at least 16 years old to create an account. By creating an account, you represent that all information you provide is accurate and that you will keep it up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You may not share, sell or transfer your account to any other person. AN KHUE SMART is entitled to assume that anyone logging in with your valid credentials is you, and is not liable for any loss or damage arising from unauthorized use of your account.

AN KHUE SMART may suspend, restrict or terminate your account at its sole discretion, including for violation of these Terms. You acknowledge that you do not own your account and have no ownership rights or interest in your account or any data associated with it.

6. Ownership and Content

All rights, title and interest in and to the Services — including all games, software, code, graphics, artwork, music, sounds, characters, names, themes, virtual items, and other content — are owned by AN KHUE SMART or its licensors and are protected by copyright, trademark and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

If you upload, post or submit any content through the Services ("User Content"), you grant AN KHUE SMART a non-exclusive, perpetual, irrevocable, worldwide, royalty-free, sublicensable and transferable license to use, reproduce, modify, adapt, publish, distribute and display such User Content in connection with the Services and AN KHUE SMART's business.

You may not edit, modify, distribute or create derivative works from any content within the Services. You acknowledge that AN KHUE SMART may monitor and record communications made through the Services for operational, security and compliance purposes.

7. Communication Facilities

The Services may include forums, chat features or other communication facilities. You are solely responsible for any content you post through such facilities and for the consequences of posting it.

You may not share the personal information of any other person without their consent. Users who violate these rules may have their content removed and may be excluded from some or all of the Services.

8. Fees and Purchases

The Services may offer virtual items, virtual currency or other digital content that can be purchased with real money ("Virtual Items"). Virtual Items are licensed to you for use within the Services only; they have no monetary value and cannot be exchanged for real money, goods or services outside the Services.

Virtual Items may not be transferred, sold or traded between accounts or users. Any attempt to do so is a violation of these Terms.

All sales performed by AN KHUE SMART are final. Except where required by applicable law or by the policies of the platform through which you made your purchase (such as the Apple App Store or Google Play), AN KHUE SMART has no obligation to provide refunds for any reason.

9. Consequences of Breach

If you breach these Terms, AN KHUE SMART may, at its sole discretion and without prior notice: remove or delete any content you have posted; temporarily or permanently block your access to the Services; suspend or disable your account; and/or terminate this agreement. AN KHUE SMART shall not be liable for any damages or losses caused by such measures or by your violation of these Terms.

10. Limitation of Liability and Indemnification

To the maximum extent permitted by applicable law, AN KHUE SMART, its directors, employees, partners and licensors shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages — including loss of profits, data, goodwill or other intangible losses — arising out of or related to your access to or use of (or inability to access or use) the Services, regardless of the cause and the theory of liability.

You agree to indemnify, defend and hold harmless AN KHUE SMART and its affiliates from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) made by any third party arising out of or related to your use of the Services or your violation of these Terms.

11. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement. AN KHUE SMART does not warrant that the Services will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the results obtained from the use of the Services will be accurate or reliable.

12. Modifications to These Terms

AN KHUE SMART may modify these Terms from time to time, including due to changes in applicable law, technical necessity, or changes in market conditions or business practices. When we make material changes, we will provide notice through the Services or by other reasonable means. Your continued use of the Services after such changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Services.

13. Eligibility and Minors

Children under the age of 13 may not use the Services directly. If you are between 13 and 18 years old (or the age of legal majority in your jurisdiction), you may only use the Services with the consent and under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

14. Miscellaneous

You may not assign or transfer your rights or obligations under these Terms without the prior written approval of AN KHUE SMART. AN KHUE SMART may assign these Terms without restriction.

The Services may contain links to third-party websites or content. AN KHUE SMART is not responsible for, and does not endorse, any third-party content, websites or services.

These Terms and any disputes arising out of or related to them or the Services shall be governed by the laws of the jurisdiction in which AN KHUE SMART operates, without regard to its conflict of law provisions. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
